This is a translation of the Hebrew Terms & Conditions (תקנון). If the two versions differ, the Hebrew version prevails.

1. General

1.1 The websites touristguideisrael.com and sa-baba.com (the “Websites”) are operated by Tourist Guide Israel (“TGI” or the “Business”), a business owned by Udi Avital, a tour guide licensed by the Israeli Ministry of Tourism.

1.2 Sa-Baba is TGI’s transport project. TGI and Sa-Baba are one business, with one owner and one business registration number, and every booking on either Website is an agreement with TGI.

1.4 These Terms apply to anyone who browses the Websites or books a service on them (the “Customer”). Making a booking or a payment means accepting these Terms. If you do not agree to them, please do not make a booking.

1.5 If these Terms conflict with anything else published on the Websites, these Terms prevail – except for a written quote or agreement sent to the Customer for a specific tour, which prevails for that tour.

2. Age limit

2.1 Booking and purchasing on the Websites is permitted only to persons aged 18 or over, with legal capacity, using a valid means of payment in their own name.

2.2 Minors (under 18) may take part in a ride or tour only within a booking made by an adult, and only if at least one adult actually accompanies them throughout the service. Such a booking, even when it includes several participants, is made in the adult’s name, and the adult is responsible for the minors included in it.

3. The services

3.1 TGI offers:

  • Private guided tours throughout Israel – a personally planned itinerary, guided by a licensed tour guide, including travel in a licensed tourist vehicle.
  • Private rides and transfers, including transfers to and from Ben Gurion Airport.

3.2 Sa-Baba sells tickets on its shuttle lines in Jerusalem, according to the routes, stops and timetables published on its Website.

3.3 Sa-Baba also runs a free community board where drivers and passengers arrange lifts and shared rides among themselves. These rides are not sold on the Website: they are arranged directly between users, and any payment between them passes directly from one to the other. TGI is not a party to these rides and is not responsible for them.

3.4 Photos, itineraries and service descriptions on the Websites are for illustration. TGI may add, change or discontinue services; such a change will not apply to a booking already confirmed, except as set out in section 6.

4. Booking and payment

4.1 Prices on the Websites are in Israeli new shekels (ILS). VAT is charged as required by law: Israeli residents pay VAT; tourists who show a foreign passport and a home address abroad are charged 0% VAT.

4.2 When booking, the Customer will be asked for personal details (name, phone, email and any other details needed for the service). The Customer must give correct and complete details; a booking with incorrect details may not be accepted.

4.3 Credit card payments on the Websites are made through a secure payment provider (Grow). Card details are entered directly on the payment page and are not stored by TGI.

4.4 A booking is confirmed only once the payment has been approved. On approval, a receipt is sent to the email address the Customer provided, and a tax invoice is sent separately.

4.5 Private tours: after the Customer approves the proposed itinerary and price, a deposit of 20% of the tour price secures the dates. The balance is paid by the first day of the tour. Payment methods: credit card, bank transfer, PayPal or cash.

4.6 Shuttle: the ticket price depends on the travel zone, as shown in the booking form, and is paid in full at booking. The ticket is valid only for the date, time and stops selected. The driver does not take payment in the vehicle.

5. Delivery of the service

5.1 The services on the Websites are guiding and transport services; no physical product is sent to the Customer.

5.2 The booking confirmation and service details are emailed to the Customer once payment is complete. A Customer who has not received a confirmation should check their spam folder and contact us.

5.3 Private tour or private ride: the service is provided on the date, at the time and at the pick-up point agreed in advance with the Customer – usually the place of stay or Ben Gurion Airport.

5.4 Shuttle: the passenger must be at the boarding stop they selected before the vehicle’s scheduled arrival time. Boarding is by the passenger’s name on the driver’s passenger list. Arrival times at stops are estimates and may change with traffic conditions.

6. Cancellation and changes

6.1 Cancellation by the Customer – private tour or private ride:

  • Cancellation given more than 7 business days before the service starts: the full amount paid is refunded, minus a cancellation fee of 5% of the transaction price or ILS 100, whichever is lower.
  • Cancellation given within the 7 business days before the service starts: the deposit is not refunded.

6.2 Cancellation by the Customer – shuttle ticket:

  • A ticket can be cancelled at any time up to the vehicle’s scheduled arrival at the boarding stop. Cancellation gives a credit for the full price, towards a future Sa-Baba ride.
  • For a ticket cancelled more than 7 business days before the ride, the passenger may choose, instead of credit, a refund minus a cancellation fee of 5% or ILS 100, whichever is lower. Refund requests are sent by email.
  • After boarding, or after the scheduled arrival time at the stop, the ticket cannot be cancelled.

6.3 How to cancel: by email, WhatsApp or phone to the contacts in section 1.3, giving the name of the person who booked and the booking details. A shuttle ticket can also be cancelled through the Website.

6.4 Refunds are made within 14 days of receiving the cancellation notice, to the means of payment used.

6.5 Senior citizens (aged 65 or over), persons with disabilities and new immigrants are entitled to extended cancellation rights under the Israeli Consumer Protection Law.

6.6 Cancellation or change by TGI: TGI may cancel or change a service because of weather, the security situation, a vehicle breakdown, illness, too few participants or force majeure. For a private tour or ride, the Customer will be offered an alternative date, and a Customer who does not want it will receive a full refund of the amount paid. For the shuttle, a ride cancelled by TGI entitles the passenger to a full refund by default; the passenger may instead choose to keep the amount as credit for a future ride.

6.7 Nothing in this section limits the Customer’s rights under the Israeli Consumer Protection Law, 5741-1981, and its regulations.

7. Liability

7.1 TGI provides its services professionally and with care. Transport is provided in vehicles licensed and insured to carry passengers, by drivers holding the appropriate licence, and tours are guided by a licensed tour guide.

7.2 Departure and arrival times, travel times and routes shown on the Websites are estimates only. TGI is not liable for delay, a change of route or indirect damage caused by traffic, road closures, weather, instructions of the authorities or other circumstances beyond its control – including a missed flight, event or meeting. For a ride with a fixed deadline, we recommend allowing extra time.

7.3 Participants must follow the instructions of the driver and the guide, wear a seat belt, and observe the safety rules on tours and walks. TGI may refuse to carry a participant who endangers themselves or others.

7.4 The Customer is responsible for their personal belongings. TGI is not responsible for items left in the vehicle or lost during the service, unless the loss was caused by its negligence.

7.5 Information on the Websites – recommendations, itineraries and content – is for general information only and is not professional advice.

7.6 To the extent permitted by law, TGI’s liability will not exceed the amount actually paid for the service in respect of which the damage occurred.

8. Force majeure

TGI is not liable for failing to provide a service, or for a delay in providing it, caused by circumstances beyond its control, such as war, the security situation, natural disaster, epidemic, strike or instructions of the authorities. In such cases section 6.6 applies.

9. Privacy and data security

9.1 TGI respects its customers’ privacy and acts in accordance with the Israeli Protection of Privacy Law, 5741-1981, and its regulations.

9.2 Information collected: name, phone and email. When booking a tour – also the group’s composition, dates, place of stay and any special requests the Customer chooses to give (for example accessibility needs). When opening a Sa-Baba account – also gender and preferred contact channel, for matching rides.

9.3 The information is used only to provide the service: carrying out the booking, contacting the Customer about it (including arrival-time updates), issuing an invoice, customer service and meeting legal requirements.

9.4 TGI will not sell information or pass it to a third party for marketing. Information is passed only to suppliers needed to run the service – the payment provider, the accounting and invoicing system, hosting and email providers – and only as far as necessary, or where the law requires it.

9.5 TGI uses customary security measures, including an encrypted connection to the Websites. However, no security is absolute, and TGI is not liable for unauthorised access to systems outside its control.

9.6 Marketing messages are sent only with explicit consent, which can be withdrawn at any time.

9.7 Every Customer may view the information held about them, and ask for it to be corrected or deleted, by writing to the email in section 1.3. Requests are answered within 30 days.

9.8 Cookies and measurement tools. The Websites use cookies and similar technologies, such as local storage in the browser, for the following purposes:
(a) Running the Website – keeping booking details between booking steps, remembering the chosen currency, and signing in to an account.
(b) Security and filtering spam in forms.
(c) Browsing statistics.
(d) Third-party content and services embedded in the Website – Google Maps, YouTube videos, reviews (Trustindex), tour listings (TourCMS) and chat (Chatling). These providers may set their own cookies and process information under their own privacy policies. The content of a chat conversation is passed to the chat provider in order to answer it.
Cookies can be blocked or deleted in the browser settings. Blocking cookies may affect how parts of the Website work, for example the booking process. Credit card details are entered on Grow’s payment page and are not stored on the Websites.

10. Intellectual property

All content on the Websites – text, photos, maps, design and the TGI and Sa-Baba marks – belongs to TGI. It may not be copied, distributed or used commercially without written permission.

11. Changes to these Terms

TGI may update these Terms from time to time. The binding version is the one published on the Website at the time the booking is made.

12. Governing law and jurisdiction

These Terms and every booking on the Websites are governed by the laws of the State of Israel. The competent courts in Jerusalem have exclusive jurisdiction.
